RAPPER Christabell ‘Kikky Badass’ Stembeni Mahlungwa has been sued over an Instagram post in which she accused lawyer, Rodney Saratoga Makausi, of trying to solicit sexual favours from her.

Kikky posted a picture of Rodney on March 2, claiming she’d rebuffed sexual demands from him.

In a letter of demand, through his lawyers, Saratoga Makausi Law Chambers, Rodney is demanding an apology, retraction and removal of the post within four days after receiving the correspondence.

“Our client has shown us a post which you uploaded on your Instagram page where you are known by the name ‘Kikky Bada**’. This picture was also downloaded by your Instagram followers and widely circulated on WhatsApp.

“The downloaded Instagram post insinuated that our client Mr Rodney Saratoga Makausi had sent text messages to you via the WhastApp platform using a South African number +27677905476. The WhatsApp messages from this South African number which allegedly sent the message to you carried a picture of Mr Rodney Saratoga Makausi.

“Your Instagram post alluded that Mr Rodney Saratoga Makausi, whose picture appeared on the post, had sent you a text message via WhatsApp soliciting for sexual favours from you.

“The Instagram post also indicated that you had rebuffed the alleged sexual advances allegedly from Mr Rodney Saratoga Makausi.”

The lawyers said her Instagram post with Rodney’s picture requested women to counsel their husbands as it was not all women who were hungry for money.

They said the post had also referred to Rodney as a creep.

“Please take note that our client whose picture you used in your post and undermined in a highly defamatory manner in your post does not use the South African number +2767790,5476 which sent you the messages. Our client has never used the said South African number at any point in time.

“Our client also did not know anything about you prior to receiving the shocking news of the posts downloaded from your Instagram post. Soon after you posted the defamatory post of our client on your Instagram account, our client started receiving the said defamatory downloaded posts from the 2nd of March 2023 from colleagues who were shocked by the said posts. Our client continues to receive telephone calls from family members, friends and others who came across your downloaded post.”

The lawyers said Rodney could not have communicated with Kikky seeking sexual favours when he did not even know her and her post was reckless and highly defamatory to him.

“We take note that your Instagram page has a huge following of over 180 000 followers, hence it has a huge reach. The WhatsApp platform also has a huge reach. The downloaded post is being highly circulated on social media as you ought to have known.

“Your Instagram post has damaged Mr Makausi’s standing as a husband, father, lawyer, businessman and a member of the Seventh-day Adventist Church. This has caused irreparable harm to him and his influence in the said capacities.

“The Instagram posts suggest the following imputations of Mr Makausi to those who will see the downloaded posts:

(i) He is a sexual predator who solicited for sexual favours from you; (ii) He is an unfaithful husband and father who cheats on his wife by soliciting for sexual favours, including from anonymous women;

(iii) He is an adulterer contrary to his valued beliefs as a Christian and member of the Seventh-day Adventist church;

(iv) He is an adulterer and sexual predator who members of the community should be wary of when they engage him as a lawyer, businessman, church member and a member of the community.”

They said her post had seriously tarnished Rodney’s good name and standing in society, and diminished his esteem.

“Your Instagram post will also cause our client to be shunned or avoided or expose him to hatred, ridicule or contempt by the general public.

“In light of the foregoing our client has instructed us to demand as we hereby do that you do the following within the course of the next four days:

1. Retract your defamatory post that our client contacted you seeking sexual favours from you.

2. Offer an unreserved apology for your Instagram post which has highly defamed our client. The unreserved apology must be directed to our client, his family, his friends and all who were offended by your post.

3. Your retraction and apology must be posted on the same social media page (lnstagram) that you posted the first defamatory article and must be kept there for at least 24 hours.

4.The retraction and apology must also be downloadable within the 24 hours it will be on your Instagram page just as the defamatory article was capable of being downloaded.

“If you do not retract your defamatory post and offer an apology within the next four days, our instructions are to institute litigation proceedings against you. In our litigation proceedings, this letter shall be produced in court.

“We shall also seek substantial damages as your refusal to adhere to this warning will be proof that your publication of the defamatory Instagram article which alleged that our client had sought sexual favours from you when they never contacted you were done deliberately and maliciously.”
