Man jailed 8 yrs for inserting fingers into friend’s wife

Things have fallen apart for an 18-year-old Filabusi man who fondled the breasts and inserted his finger into the privates of his friend’s wife.

Wayne Sibanda of Bekezela Township appeared before Gwanda regional magistrate, Mr Mark Dzira facing charges of aggravated indecent assault.

The court heard that Sibanda fondled the woman’s (name withheld for ethical reasons) breasts and inserted his finger into her privates at around 4 AM after he discovered that the woman was home alone when he came to collect his helmet which he had lent to her husband.

In his defense Sibanda said

I deny the allegations levelled against me Your Worship as I didn’t touch this woman as she has alleged. She is the one who called me on my cell phone in the middle of the night at around 1 AM asking about the whereabouts of her husband as he was not home.

I told her that I didn’t know and she then asked me to come to her house. I refused to go there seeing that it was in the middle of the night, even though she insisted. I then went to her house at around 6 AM to collect the work helmet that I had given to her husband. I found her lying on the bed and she opened the blankets revealing her naked body and invited me to have sexual intercourse with her. Instead, I didn’t touch her at all but I left the house.

The prosecution, on the other hand, managed to convince the magistrate that when Sibanda discovered that his friend was not at home, he approached the complainant who was lying in bed and fondled her breasts and inserted his finger into her privates. He is said to have only left after the complainant screamed.

The complainant notified her husband when he returned home and the two promptly filed a police report.

Despite his spirited denial, Gwanda regional magistrate, Mr Mark Dzira said there was overwhelming evidence of his crime and sentenced him to 8 years in prison. Three  were suspended for good behaviour leaving an effective five…..Chronice
