ED S_ex Scandal: Magistrate Rejects Application For Constitutional Court Referral

OPPOSITION Ideal Zimbabwe leader, Tinashe Jonasi, who landed in the dock for claiming President Emmerson Mnangagwa was bedding Information Minister, Monica Mutsvangwa, had his application seeking referral of his case to Constitutional Court trashed.

Jonasi wanted his case to be referred to Con-Court on grounds that he did not commit any crime because freedom of speech is a constitutional right

But Harare magistrate ruled that he should have led evidence defending his reason for his application to have the case referred to the Con-Court.

“There is no statement of agreed facts from both the State and defense. The court is left with no option but to continue with the trial. It was incumbent upon the accused to lead evidence to support his application, but he did not. The application for exception is hereby dismissed,” ruled Magistrate Rumbidzai Mugwagwa.

Jonasi is facing a charge of undermining Mnangagwa’s authority.

He, according to the State, accused the President of infidelity and having a child with war veterans’ leader Christopher Mutsvangwa’s wife.

The opposition leader argued that the State has no evidence against him, instead, demanding that Mnangagwa appears before the court to prove his innocence from the adultery claims.NewZimbabwe
